Insurance for Custom Farming
Nut Harvesting Operations
Custom nut harvesting—shaking, sweeping, collecting, and hauling almonds, walnuts, pecans, pistachios, and other tree nuts—involves high-value specialized equipment operating on third-party orchards under tight seasonal windows. The right insurance program protects your equipment, your crew, your liability exposure, and the continuity of your business when something goes wrong.
What Coverage Typically Looks Like
Commercial General Liability (CGL) / Farm Liability with Custom Farming Endorsement — Protects against claims of bodily injury and property damage arising from your operations on a grower’s land. This includes damage to trees, irrigation systems, fences, drainage, roads, and neighboring property. Standard farm policies often limit or exclude custom work once annual receipts exceed a modest threshold (commonly $5,000–$10,000). A dedicated custom farming liability endorsement or a full CGL designed for agricultural contractors removes that limitation.
Equipment / Inland Marine (Farm Personal Property Floater) — Tree shakers, harvesters, sweepers, elevators, and support implements can each represent $200,000–$300,000+ in value. Coverage should follow the equipment in the field, in transit between orchards, and in storage. Preferred valuation is replacement cost or agreed value rather than actual cash value (depreciated), which can leave a large gap after a total loss.
Commercial Auto / Fleet — Covers trucks, semis, and support vehicles used to move equipment and harvested nuts. Multi-state operations need proper filings and hired/non-owned auto coverage when additional trucks are rented during peak season.
Workers’ Compensation — Protects employees injured while operating equipment or working in the field. Even in states that exempt agricultural workers, voluntary coverage is strongly recommended; without it, a serious injury can result in an uninsured lawsuit against the operator. Multi-state circuits require attention to each state’s rules.
Umbrella / Excess Liability — Extends limits above the primary GL, auto, and employers liability policies. Many custom nut harvest operations carry $2 million to $5 million (or more) in umbrella coverage given the value of the orchards they work on.
Coverage Gaps That Are Easy to Miss
• Custom farming exclusion or low receipt limit on a standard farmowners policy — liability claims arising from paid harvest work may be denied once receipts exceed the policy’s automatic limit.
• Underinsured or improperly scheduled equipment — using actual cash value or failing to schedule high-value machines leaves large out-of-pocket costs after a fire, overturn, or theft.
• Transit and off-premises exposures — equipment coverage that does not travel with the machine between jobs, or insufficient cargo limits when hauling harvested nuts.
• Workers’ compensation gaps — especially across state lines or when relying on seasonal labor contractors without verifying coverage and certificates.
• No additional-insured status or certificates — growers increasingly require proof that the custom operator carries adequate liability and will name the grower as an additional insured before work begins.
• Chemical or pesticide application — if any spraying is performed, most liability policies exclude it unless a specific endorsement is added.
• Business interruption / loss of income — a destroyed shaker or injured key operator during the short harvest window can wipe out a season’s revenue with no coverage to replace lost contracts.
• Outdated schedules and ownership changes — equipment lists, named insureds, and corporate structure must be kept current; policies that lag behind the actual operation create gaps at claim time.
Why the Right Coverage Matters
Nut harvest windows are short and unforgiving. A single equipment loss, a serious injury claim, or liability for damage to high-value orchard trees can threaten the financial survival of a custom operation. Proper coverage preserves the ability to replace equipment quickly, defend against lawsuits, meet contractual requirements from growers, and continue operating through the next season. It also protects personal assets when the business is structured as a sole proprietorship or partnership. Reviewing the program annually—before harvest—with an agent who understands agricultural contractor risks is one of the highest-leverage risk management steps a custom nut harvester can take.
